The Insurance Gap: Your AI Mistakes May No Longer Be Covered
Insurers are carving AI out of standard liability policies because they can't price it yet. Finance leaders should check their renewals now.
If an AI error hits your P&L next year, check who's actually paying. It may no longer be your insurer.
📰 THE NEWS
Standard generative-AI exclusion endorsements for US commercial general liability took effect in January 2026. Berkshire Hathaway, Chubb and Travelers have sought regulatory approval to exclude AI-related damages from general liability, and Berkley has introduced an "absolute" AI exclusion in several specialty lines. The root cause: Capgemini found 42% of insurers track no AI metrics at all, and what can't be priced gets excluded. Meanwhile Munich Re and specialists such as Armilla and Corgi now sell standalone AI liability cover.
🔄 THE PIVOT
For years, AI risk sat silently inside general, cyber and E&O policies. That silent cover is being stripped out and sold back separately, with conditions attached. If AI touches your reporting, payments or customer communications, your risk profile changed, and your policy may have too.
✅ ACTIONABLE TIP for CFOs and risk owners at renewal
1. Ask your broker in writing: which of our policies now carry AI exclusions or sublimits?
2. Map where AI touches money: payments, financial reporting, customer communications, credit decisions.
3. Document your AI governance (inventory, human sign-off, logs). Firms with evidence are the ones getting affirmative cover.
4. Size the gap: what would a material AI error cost, and who pays for it today?
💬 Has your insurance renewal asked about your AI use yet: yes, no, or "we haven't checked"?
